4. Quotes and Estimates

4.1. Validity: All quotes and estimates provided by Brand Shark are valid for 30 days from the date of issuance, unless otherwise specified in writing.
4.2. Changes: Additional charges may apply if the order criteria change after a quote has been provided. This includes, but is not limited to, changes in quantity, design, materials, or shipping requirements.
4.3. Accuracy: While we strive for accuracy, we reserve the right to correct any errors in pricing or product information prior to the acceptance of an order.

5. Order Placement and Acceptance

5.1. Order Confirmation: All orders are subject to acceptance by Brand Shark. We will confirm acceptance via email or other written communication.
5.2. Cancellation: Orders may be cancelled without penalty within 24 hours of placement, provided production has not begun. Cancellations after this period may incur fees.

6. Payment Terms

6.1. Pricing: All prices are in US Dollars and are subject to change without notice.
6.2. Payment Methods: We accept all major credit cards and debit cards.
6.3. Deposits: All orders are prepay unless otherwise agreed upon payment terms by both parties.
6.4. Late Payments: Overdue payments may incur interest charges and result in suspension of services.

7. Shipping and Delivery

7.1. Timeframes: Delivery times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers or customs.
7.2. Shipping Costs: Shipping costs are calculated based on the delivery address and order specifications.
7.3. Risk Transfer: Risk of loss and title for products pass to you upon delivery to the carrier.

8. Custom Designs and Artwork

8.1. Ownership: You guarantee that you own or have permission to use any artwork or designs submitted for production.
8.2. License: You grant Brand Shark a non-exclusive license to use submitted artwork for the purpose of fulfilling your order.
8.3. Proofs: We will provide proofs for approval before production. You are responsible for carefully reviewing and approving all proofs.

9. Product Quality and Returns

9.1. Inspection: You should inspect all products upon receipt and notify us of any issues within 5 business days.
9.2. Defects: We will replace or refund products with manufacturing defects at our discretion.
9.3. Custom Products: Custom-made products cannot be returned unless defective.

10. Intellectual Property

All content on our website and marketing materials, including logos, designs, and text, is the property of Brand Shark and protected by copyright laws.

11. Limitation of Liability

Brand Shark's liability is limited to the cost of the products purchased. We are not liable for any indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold Brand Shark harmless from any claims, losses, or damages arising from your use of our services or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of North Carolina, USA without regard to its conflict of law provisions.
